Terms of Service

Please read these Terms of Service carefully before using PolyWager.io. By accessing or using the Platform, you agree to be bound by these terms.

Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and PolyWager B.V. ("PolyWager," "we," "us," or "our"), a company organized and existing under the laws of Curaçao, operating the website located at polywager.io and all related services (collectively, the "Platform").

By creating an account, depositing funds, placing a wager, or otherwise accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to any part of these Terms, you must not access or use the Platform and must immediately discontinue any existing use.

You represent and warrant that you are at least eighteen (18) years of age, or the minimum legal age for gambling in your jurisdiction, whichever is greater. You further represent that you possess the legal authority and capacity to enter into a binding agreement with PolyWager and that your use of the Platform does not violate any applicable law, regulation, or third-party obligation.

These Terms incorporate by reference our Privacy Policy, Responsible Gaming Policy, Anti-Money Laundering (AML) Policy, and any game-specific rules published on the Platform. In the event of a conflict between these Terms and any game-specific rules, these Terms shall prevail unless explicitly stated otherwise.

Definitions

For the purposes of these Terms, the following definitions shall apply:

Platform
The PolyWager.io website, mobile applications, application programming interfaces (APIs), and all associated services operated by PolyWager B.V.
User / Account Holder
Any individual who creates an account on the Platform and agrees to these Terms.
Account
The personal account created by a User on the Platform, identified by a unique username and secured by authentication credentials.
Digital Assets
Cryptocurrencies and blockchain-based tokens accepted by the Platform for deposits, wagers, and withdrawals, including but not limited to Bitcoin (BTC), Ethereum (ETH), Litecoin (LTC), USDT, USDC, and Solana (SOL).
Wager / Bet
Any stake placed by a User on a game or event offered on the Platform, denominated in Digital Assets or their platform-equivalent balance.
House Edge
The statistical advantage held by the Platform on each game, expressed as a percentage of the total amount wagered, as disclosed in the rules for each respective game.
Provably Fair
A cryptographic verification system that allows Users to independently verify the fairness and randomness of each game outcome using published server seeds, client seeds, and nonce values.
KYC (Know Your Customer)
The identity verification process required by applicable regulations and PolyWager’s internal compliance policies, which may include submission of government-issued identification, proof of address, and source of funds documentation.
Restricted Territory
Any jurisdiction in which the use of the Platform is prohibited by applicable law or by PolyWager’s internal policies, as set forth in Section 4 of these Terms.

Account Registration & Security

3.1 Registration

To use the Platform, you must create an account by providing a valid email address, choosing a unique username, and setting a secure password. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate and complete.

3.2 Identity Verification (KYC)

PolyWager is committed to complying with all applicable anti-money laundering and counter-terrorism financing regulations. We may, at our sole discretion and at any time, require you to undergo identity verification. This process may include, but is not limited to, the submission of:

  • A valid government-issued photo identification document (passport, national identity card, or driver’s license)
  • Proof of residential address dated within the last three (3) months (utility bill, bank statement, or official government correspondence)
  • Source of funds documentation demonstrating the legitimate origin of deposited Digital Assets
  • A selfie or live photo for biometric comparison with the submitted identification document

Until the KYC process is satisfactorily completed, we reserve the right to restrict or suspend deposits, withdrawals, gaming activities, or any other Platform functionality. Failure to complete verification within the timeframe specified by PolyWager may result in account closure and forfeiture of any promotional or bonus balances.

3.3 Account Security

You are solely responsible for maintaining the confidentiality and security of your account credentials. You agree to immediately notify PolyWager of any unauthorized access to or use of your account. We strongly recommend enabling two-factor authentication (2FA) on your account. PolyWager shall not be liable for any loss or damage arising from your failure to safeguard your account credentials or to enable available security features.

3.4 One Account Policy

Each User is permitted to hold only one (1) active account on the Platform. The creation or use of multiple accounts by a single individual is strictly prohibited. If PolyWager determines, in its sole discretion, that a User operates or has operated multiple accounts, we reserve the right to immediately suspend or close all associated accounts, void any pending wagers, and confiscate any balances or winnings linked to those accounts.

Eligible Users

4.1 Age Requirement

You must be at least eighteen (18) years of age, or the minimum legal age for gambling in your jurisdiction (whichever is higher), to create an account and use the Platform. PolyWager reserves the right to request proof of age at any time and to suspend or close accounts where the User is found to be underage. Any winnings accrued by an underage User shall be forfeited.

4.2 Geographic Restrictions

The Platform is not available to Users located in, residing in, or citizens of the following Restricted Territories. This list is non-exhaustive and subject to change at PolyWager's sole discretion:

  • United States of America and its territories (including Puerto Rico, U.S. Virgin Islands, Guam, and American Samoa)
  • United Kingdom of Great Britain and Northern Ireland
  • Australia
  • France and its overseas territories
  • The Netherlands (including Bonaire, Sint Eustatius, and Saba)
  • Spain
  • Italy
  • Turkey
  • Czech Republic
  • Belgium
  • Portugal
  • Sweden
  • Denmark
  • Singapore
  • Hong Kong SAR
  • Iran, North Korea, Syria, Cuba, Sudan, and any other jurisdiction subject to comprehensive international sanctions
  • Any other jurisdiction where online gambling with Digital Assets is prohibited by applicable law

By using the Platform, you represent and warrant that you are not located in, residing in, or a citizen of any Restricted Territory. The use of virtual private networks (VPNs), proxy servers, or any other technology to circumvent geographic restrictions is strictly prohibited and constitutes a material breach of these Terms.

4.3 Compliance with Local Laws

It is your sole responsibility to determine whether your use of the Platform is lawful in your jurisdiction. PolyWager makes no representations or warranties regarding the legality of the Platform's services in any particular jurisdiction. By accessing the Platform, you accept full responsibility for ensuring compliance with all laws and regulations applicable to you.

Deposits & Withdrawals

5.1 Supported Cryptocurrencies

The Platform accepts deposits and processes withdrawals in the following Digital Assets, subject to change at PolyWager's discretion with reasonable notice:

  • Bitcoin (BTC)
  • Ethereum (ETH)
  • Litecoin (LTC)
  • Tether (USDT) — ERC-20 and TRC-20 networks
  • USD Coin (USDC) — ERC-20 and Solana networks
  • Solana (SOL)
  • Additional cryptocurrencies as announced on the Platform

5.2 Deposits

Deposits are credited to your account balance upon the required number of blockchain confirmations for the respective network. Confirmation requirements vary by cryptocurrency and are displayed on the deposit page. PolyWager does not charge fees for deposits; however, you are responsible for any blockchain network (gas/transaction) fees required to send your Digital Assets to the Platform.

Minimum deposit amounts are displayed on the Platform for each supported cryptocurrency. Deposits below the stated minimum may not be credited and may be irrecoverable. You must only deposit from wallets that you own and control. Deposits from third-party wallets, mixing services, or sanctioned addresses may be frozen pending investigation.

5.3 Withdrawals

Withdrawal requests are processed within twenty-four (24) hours under normal operating conditions. PolyWager reserves the right to extend processing times for security reviews, compliance checks, or during periods of high network congestion. Minimum and maximum withdrawal limits are displayed on the Platform and may vary by account verification level and VIP tier.

A network fee may be deducted from the withdrawal amount to cover blockchain transaction costs. The applicable fee is displayed prior to confirming the withdrawal. PolyWager reserves the right to request additional KYC documentation before processing any withdrawal, particularly for withdrawals that exceed established thresholds.

5.4 Blockchain Risks & Irreversibility

You acknowledge and accept that blockchain transactions are inherently irreversible. Once a deposit or withdrawal has been broadcast to the blockchain network, it cannot be cancelled, reversed, or refunded. PolyWager is not responsible for any loss resulting from:

  • Deposits sent to an incorrect wallet address or on an unsupported network
  • Blockchain network congestion, forks, or reorganizations
  • Fluctuations in the value of Digital Assets between the time of deposit and the time of withdrawal
  • Failures, delays, or errors in third-party blockchain networks or services
  • Loss of private keys or access to external wallets

Gaming Rules

6.1 Provably Fair System

All games offered on the Platform utilize a provably fair system based on cryptographic hash functions. Before each game round, a server seed hash is published. Upon completion of the round, the server seed, combined with the client seed and nonce, allows Users to independently verify that the game outcome was determined fairly and was not manipulated. Detailed verification instructions and tools are available on the Platform.

6.2 House Edge Disclosure

Each game on the Platform has a disclosed house edge, which represents the statistical advantage retained by PolyWager over the long term. The house edge for each game is transparently published on the respective game page and in the game-specific rules. House edge values are subject to change with reasonable notice. Users acknowledge that the house edge ensures that, statistically, the Platform will retain a percentage of total amounts wagered over time.

6.3 Bet Limits

Minimum and maximum bet limits are established for each game and may vary based on the User's account verification level, VIP tier, and current Platform liquidity. PolyWager reserves the right to adjust bet limits at any time without prior notice. Any wager placed that exceeds the applicable limits may be voided at PolyWager's discretion.

6.4 Void & Cancelled Rounds

In the event of a system error, network disruption, or any irregularity that compromises the integrity of a game round, PolyWager reserves the right to void the affected round. When a round is voided, all wagers placed during that round will be refunded to the respective Users' account balances. PolyWager's determination as to whether a round should be voided is final and binding.

6.5 Malfunction Policy

In the event of a software or hardware malfunction, all affected wagers and payouts are deemed void. "Malfunction" includes, but is not limited to, software bugs, server failures, data corruption, display errors, and network interruptions. In such cases, PolyWager will make commercially reasonable efforts to restore User account balances to their pre-malfunction state. PolyWager's records shall be the final authority in determining the correct account balance.

6.6 Final Results

The results of all games as recorded on PolyWager's servers are final and binding. In the event of a discrepancy between the result displayed on a User's device and the result recorded on PolyWager's servers, the server record shall prevail.

Responsible Gaming

PolyWager is committed to promoting responsible gaming and providing tools to help Users maintain control over their gaming activity. Gambling should be treated as a form of entertainment, not as a source of income or a means to recover financial losses.

7.1 Self-Exclusion

Users may request to be self-excluded from the Platform for a defined period (24 hours, 7 days, 30 days, 90 days, or permanently). During the self-exclusion period, the User's account will be disabled, and they will be unable to log in, place wagers, or access any gaming functionality. Permanent self-exclusion is irreversible. To initiate a self-exclusion, visit the Responsible Gaming section of your account settings or contact our support team.

7.2 Deposit Limits

Users may set daily, weekly, or monthly deposit limits through their account settings. Once a deposit limit is reached, no further deposits will be accepted until the applicable period resets. Decreases to deposit limits take effect immediately. Increases to deposit limits are subject to a mandatory 24-hour cooling-off period before taking effect.

7.3 Loss Limits

Users may set daily, weekly, or monthly loss limits. When a loss limit is reached, the User will be unable to place further wagers until the applicable period resets. As with deposit limits, decreases take effect immediately and increases are subject to a 24-hour cooling-off period.

7.4 Wager Limits & Session Reminders

Users may configure wager limits (maximum bet per round) and session time reminders that display a notification after a specified period of continuous play. These features are accessible through your account settings.

7.5 Cooling-Off Period

Users who wish to take a temporary break without formal self-exclusion may activate a cooling-off period of 24 hours, 48 hours, or 7 days. During this period, the account remains active, but all gaming functionality is suspended.

Intellectual Property

8.1 Platform Ownership

The Platform, including but not limited to its software, code, design, graphics, user interface, audio, video, text, algorithms, data, and all other content and materials (collectively, "Platform Content"), is the exclusive property of PolyWager B.V. or its licensors and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8.2 Limited License

Subject to your compliance with these Terms, PolyWager grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Platform solely for your personal, non-commercial entertainment purposes. This license does not include any right to: (a) modify, copy, distribute, or create derivative works based on the Platform Content; (b) reverse engineer, decompile, or disassemble any aspect of the Platform; (c) use data mining, robots, or similar data gathering or extraction methods; or (d) download, store, reproduce, or redistribute any Platform Content except as incidental to normal use of the Platform.

8.3 User-Generated Content

To the extent that Users submit, post, or transmit any content on the Platform (including but not limited to chat messages, usernames, and profile information), you grant PolyWager a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, distribute, display, and create derivative works from such content in connection with the operation and promotion of the Platform.

8.4 Trademarks

"PolyWager," the PolyWager logo, and all related names, logos, product and service names, designs, and slogans are trademarks of PolyWager B.V. or its affiliates. You may not use such marks without the prior written permission of PolyWager. All other names, logos, product and service names, designs, and slogans on the Platform are the trademarks of their respective owners.

Prohibited Activities

You agree not to engage in any of the following prohibited activities when using the Platform. Violation of any of these prohibitions constitutes a material breach of these Terms and may result in immediate account suspension or termination, forfeiture of funds, and referral to relevant law enforcement authorities:

9.1 Fraud & Deception

  • Providing false, misleading, or inaccurate information during registration, KYC verification, or at any other time
  • Using stolen, borrowed, or unauthorized Digital Assets or payment methods
  • Engaging in chargeback fraud or attempting to reverse legitimate transactions
  • Impersonating another individual or entity

9.2 Collusion & Manipulation

  • Colluding with other Users to gain an unfair advantage in any game or promotion
  • Manipulating game outcomes through exploitation of software vulnerabilities, bugs, or glitches
  • Engaging in matched betting, arbitrage abuse, or any other technique designed to guarantee profit at the Platform’s expense without genuine risk

9.3 Automated Activity

  • Using bots, scripts, automated software, or any artificial intelligence tools to interact with the Platform or place wagers without prior written authorization from PolyWager
  • Employing any form of screen scraping, data harvesting, or automated data extraction
  • Interfering with or disrupting the Platform’s servers, networks, or infrastructure through denial-of-service attacks or any other means

9.4 Multiple Accounts

  • Creating, operating, or controlling more than one account on the Platform
  • Allowing any third party to use your account or accessing another User’s account
  • Using multiple accounts to exploit promotions, bonuses, or referral programs

9.5 Money Laundering & Financial Crime

  • Using the Platform for the purpose of money laundering, terrorist financing, or any other financial crime
  • Depositing Digital Assets derived from illegal activities or sanctioned sources
  • Structuring transactions to evade reporting thresholds or compliance controls
  • Using the Platform as a cryptocurrency exchange or money transmission service

9.6 Exploiting Bugs & Errors

If you discover any bug, error, or vulnerability in the Platform, you are required to report it to PolyWager immediately and to refrain from exploiting it. Any funds gained through the exploitation of bugs or errors may be reclaimed by PolyWager without notice. Users who responsibly disclose vulnerabilities may be eligible for rewards under our Bug Bounty program.

Privacy & Data Protection

Your privacy is important to us. PolyWager collects, processes, and stores personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your data as described therein.

10.1 Data We Collect

We may collect the following categories of information:

  • Account registration data (email address, username, encrypted password)
  • Identity verification documents and biometric data submitted during the KYC process
  • Transaction data (deposits, withdrawals, wagers, and game history)
  • Device and browser information, IP addresses, and geolocation data
  • Communications with our support team
  • Cookies, analytics data, and usage patterns as described in our Cookie Policy

10.2 Data Usage

We use your data to operate the Platform, process transactions, verify your identity, comply with legal obligations, prevent fraud and financial crime, improve our services, and communicate with you about your account and our products. We do not sell your personal data to third parties. Data may be shared with regulatory authorities, law enforcement, and service providers as set forth in our Privacy Policy.

10.3 Data Retention

We retain personal data for as long as your account is active and for a minimum of five (5) years following account closure, or such longer period as required by applicable law or regulation. Transaction records and gaming history may be retained indefinitely for regulatory compliance and audit purposes.

Limitation of Liability

11.1 No Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POLYWAGER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

11.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POLYWAGER, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM, REGARDLESS OF THE THEORY OF LIABILITY.

POLYWAGER'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT OF DIGITAL ASSETS DEPOSITED BY YOU INTO YOUR ACCOUNT DURING THE TWELVE (12) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE THOUSAND UNITED STATES DOLLARS (USD $1,000), WHICHEVER IS LESS.

11.3 Blockchain & Market Risks

You acknowledge and accept that:

  • The value of Digital Assets is highly volatile and may fluctuate significantly. PolyWager is not responsible for any loss of value between the time of deposit and withdrawal.
  • Blockchain networks are decentralized and may experience congestion, forks, reorganizations, or protocol changes that are beyond PolyWager’s control.
  • Smart contract interactions carry inherent risks, including but not limited to vulnerabilities, exploits, and unexpected behavior.
  • Regulatory changes may affect the availability, functionality, or legality of the Platform or Digital Assets in your jurisdiction.
  • PolyWager does not provide financial, investment, tax, or legal advice. Any decisions you make regarding Digital Assets are made at your own risk.

11.4 No Guarantee of Availability

PolyWager does not guarantee that the Platform will be available at all times or that it will operate without interruption or error. The Platform may be temporarily unavailable due to scheduled maintenance, unscheduled maintenance, network issues, force majeure events, or other circumstances beyond our reasonable control.

Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Curaçao, without regard to its conflict of law provisions. Any references to the applicability of consumer protection laws of your jurisdiction are expressly excluded to the maximum extent permitted by law.

12.2 Complaint Procedure

If you have a complaint or dispute regarding any aspect of the Platform or these Terms, you must first submit a written complaint to our support team at support@polywager.io. Your complaint must include your username, a detailed description of the issue, the date(s) on which the issue occurred, and any supporting evidence. We will acknowledge receipt of your complaint within forty-eight (48) hours and endeavor to provide a substantive response within fourteen (14) business days.

12.3 Escalation

If your complaint is not resolved to your satisfaction through the internal complaint procedure, you may escalate the matter to an independent alternative dispute resolution (ADR) provider approved by the licensing authority of Curaçao. Details of the applicable ADR provider are available upon request.

12.4 Binding Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms that cannot be resolved through the complaint procedure or ADR shall be finally settled by binding arbitration administered in accordance with the arbitration rules of the Curaçao Arbitration Institute. The arbitration shall be conducted in English, and the seat of arbitration shall be Willemstad, Curaçao. The arbitral award shall be final and binding upon both parties and may be enforced in any court of competent jurisdiction.

12.5 Class Action Waiver

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST POLYWAGER.

Account Termination

13.1 Termination by the User

You may close your account at any time by contacting our support team at support@polywager.io or through the account settings page. Before closure, you must withdraw any remaining balance in your account. Account closure requests will be processed within seven (7) business days, subject to completion of any pending transactions, open wagers, or outstanding compliance requirements.

13.2 Termination by PolyWager

PolyWager reserves the right to suspend or terminate your account, with or without prior notice, for any of the following reasons:

  • Breach of any provision of these Terms
  • Suspected or confirmed fraudulent, illegal, or unauthorized activity
  • Failure to complete KYC verification within the required timeframe
  • Operation of multiple accounts
  • Use of the Platform from a Restricted Territory
  • Extended period of inactivity (twelve months or more with no login or transaction)
  • Request from a competent regulatory or law enforcement authority
  • Any other reason deemed necessary by PolyWager to protect the integrity and security of the Platform

13.3 Effect of Termination

Upon account termination, all rights granted to you under these Terms will immediately cease. If your account is terminated by PolyWager for reasons other than a material breach of these Terms or suspected illegal activity, you will be permitted to withdraw any verified, non-bonus balance remaining in your account, subject to applicable KYC and compliance requirements. In cases of termination for breach or suspected illegal activity, PolyWager reserves the right to freeze and confiscate any remaining balance pending investigation and potential referral to law enforcement.

13.4 Dormant Accounts

Accounts that remain inactive for a period of twelve (12) consecutive months (no login, no wager, and no transaction) may be classified as dormant. PolyWager reserves the right to charge a monthly dormancy fee, the amount of which will be communicated to the registered email address before it is applied. If the account balance reaches zero as a result of dormancy fees, the account may be permanently closed.

Modifications to Terms

PolyWager reserves the right to modify, amend, or replace these Terms at any time and at its sole discretion. When we make material changes, we will:

  • Update the “Last Updated” date at the top of these Terms
  • Publish the revised Terms on the Platform
  • Notify registered Users via email and/or through an in-Platform notification at least seven (7) days prior to the effective date of the changes, except where a shorter notice period is required by law or regulation

Your continued use of the Platform after the effective date of any modification constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Platform and close your account. It is your responsibility to review these Terms periodically for changes. Non-material changes, such as typographical corrections or clarifications that do not alter the substantive meaning of these Terms, may be made without prior notice.

We aim to respond to all inquiries within forty-eight (48) hours during regular business hours (Monday through Friday, 09:00–18:00 AST, excluding public holidays).
